Radhey Krishna Legal Aid Foundation (Regd.) is a Charitable Trust established in the fond memory of Late Sh. Radhey Shyam Garg (R.S. Garg) Advocate and his wife Late Smt. Krishna Garg on 25-11-2016. Late Sh. R.S. Garg was one of the leading lawyers in court at Delhi. Moreover, he was very benevolent and compassionate by nature and used to provide legal aid to poor and needy persons on pro bono basis. Late Smt. Krishna Garg being a pious lady always supported her husband in his charitable activities.

The Foundation is run and managed by it’s Managing Trustee Mr. Ajay Garg Advocate with active support from the Lawyers/Students of law/Volunteers from different fields to help and provide Free Legal Aid to the poor, deprived, needy, downtrodden and the handicapped people to protect their rights as well as to generate awareness among people about issues that concern everyone, from civil liberties to environment to legal literacy. The Foundation is dedicated to the cause of protecting public interest, taking up causes of general public importance for legal redressal and turning lawyers into researcher and socially responsible professionals.

Objectives and Activities:-

The Legal Aid functions that it performs are preventive, remedial, activist and reformative. It provides assistance to people who are otherwise unable to afford legal representation and access to the court system. It aims at providing them access to justice by ensuring equality before the law, the right to counsel and the right to a fair trial. The Foundation is conscious of the fact that Legal aid is essential to guaranteeing equal access to justice for all, as provided for by Article 6.3 of the European Convention on Human Rights regarding criminal law cases.

It is unfortunate that the overall percentage of legal awareness as well as Legal Aid is poor in our country being thickly populated and largely poor. Although legal Aid is being provided by public spirited lawyers and other such persons on individual basis from time to time but this foundation is an attempt to institutionalize the entire system of legal aid to make it more effective and efficient so that it can reach and cater to the remote areas also.

Activities and Programmes:
In a short span of about One year, Radhey Krishna Legal Aid Foundation has helped several needy and deprived sections of society and has been actively pursuing their causes/cases free of cost on pro bono basis in every possible forum including contesting court cases for their rights from the District Courts till Supreme Court of India.

The Foundation has helped several Indian families from different religions from remote areas of different states (U.P. to Tamil Nadu) in India to get the compensation of about INR 3.5 Cr. from the UAE Administration for the death of 6 Indians who died in the Gulf war in 2016 while working at UAE Companies. The foundation was well appreciated by the recipient of services from time to time and it is also evident from the News Item dated 22-01-2017 which is attached.

The Foundation is running a project of providing Free Legal Aid to prisoners/inmates in Tihar Central Jails and Rohini Jail which includes Legal Consultations and taking up and conducting their matters in Courts (from Lower court till Supreme Court) and providing them Free, effective and competent legal services and we have already served hundreds of inmates. The Director General of Delhi prisons has permitted our Foundation to provide free legal aid to the prisoners (which is generally not given to NGO) and Our team of Lawyers are visiting the Jails twice in a week and providing all kind of legal assistance and consultations free of cost. During our service, we have come across several poor men, women, children, handicapped, old, infirm, persons with special needs languishing in Jails and some of them have been granted bail by the courts but they could not be released since they don’t have any surety and/or bail amount. Some of them are falsely implicated and are lying in Jails for long time. Many of them belong to poor strata and don’t have arrangements to pay lawyer’s fee and have no legal aid to contest their cases. We believe it is our bounden moral duty to help them and provide them all kind of legal aid and assistance and also work towards their rehabilitation and reformation.

The Foundation has also organized Free Legal Aid Camps at different places in Delhi with the help of Social and religious Organizations and NGOs and we are planning to expand our activities to reach the masses.

The research team of the Foundation is also helping Delhi Police to speed up the Investigations of the crimes and to make it more effective, efficient and formidable.

We are also working on making the poor people aware about the benefits from Governments programmes and schemes and help them getting those benefits and to fight for them if they are deprived of their rightful dues.

The Foundation has the required infrastructure and is assisted by a team of experienced and competent Lawyers in all the District Courts (Tis Hazari, Patiala House, Rohini, Dwarka, Saket, Karkardooma) as well as Hon’ble High Court of Delhi and Hon’ble Supreme Court of India for providing legal aid and help to needy persons.

Plans and programmes:
Besides, organizing Free Legal Aid Clinics and project of providing legal aid at the Central Jails at Delhi, the foundation is planning to expand it’s activities in the Jails of other states of India with the help of public spirited persons of those states.

The Foundation is a NON PROFIT making Organization and is committed to providing free Legal help/Aid and awareness to the poor, needy, deprived and deserving sections of our society.

This Foundation has received Income Tax exemption under Section 80G of Income Tax Act and therefore, all donations to Foundation are eligible for an Income tax exemption under section 80G.
